Terms of Service

1. Acceptance of Terms

By accessing or using DriftRoute ("the Service"), operated by DriftRoute, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

By creating an account, you represent that you have the authority to bind yourself or your organization to these Terms.

2. Description of the Service

DriftRoute is a web-based platform that enables hospitality businesses to create, manage, and share custom points of interest (POIs), curated routes, and interactive maps with their guests. The Service includes route planning tools, collaborative editing, map embedding, and a guest-facing experience.

3. Account Registration & Eligibility

To use the Service, you must create an account with a valid email address, organization name, and chosen subdomain. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account. By registering, you represent that the information you provide is accurate and complete.

4. Free Trial & Billing

New accounts receive a 30-day free trial with full access to all features. At the end of the trial period, your subscription automatically converts to a paid plan at $50 per month unless you cancel before the trial ends.

Billing is processed through Stripe. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring monthly basis. All fees are in US dollars and are non-refundable except as required by law.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to the Service until then.

5. Customer Content & Data

You retain all ownership rights to the content you upload, create, or manage through the Service, including POIs, routes, photos, descriptions, and other materials ("Customer Content").

By using the Service, you grant us a limited, non-exclusive license to host, store, display, and transmit your Customer Content solely for the purpose of operating and providing the Service. This license terminates when you delete your content or close your account.

You are solely responsible for your Customer Content and represent that you have the necessary rights to upload and share it.

6. Acceptable Use

You agree not to use the Service to:

  • Upload or share content that is illegal, defamatory, obscene, or infringes on the rights of others
  • Distribute spam, malware, or unsolicited communications
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Interfere with or disrupt the Service's infrastructure or other users' access
  • Use the Service in a way that violates any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual Property

The Service — including its design, code, features, documentation, and branding — is the property of DriftRoute, Inc. and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

As stated in Section 5, you retain ownership of your Customer Content.

8. Third-Party Services

The Service integrates with third-party providers to deliver its functionality:

  • Mapbox — map rendering and geocoding
  • Stripe — payment processing and subscription billing
  • Cloudflare — hosting, content delivery, and database infrastructure
  • Resend — transactional email delivery

Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the practices or availability of third-party services.

9. Termination

You may close your account at any time by contacting us at colin@driftroute.io.

We may suspend or terminate your account if you violate these Terms, fail to pay fees when due, or if we discontinue the Service. We will make reasonable efforts to provide notice before termination except in cases of severe violations.

Upon termination, your right to use the Service ceases. You may request deletion of your Customer Content by emailing us, and we will comply within a reasonable timeframe.

10. Limitation of Liability

To the maximum extent permitted by law, DriftRoute, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless DriftRoute, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your Customer Content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
